1. Acceptance

These Terms of Service ("Terms") govern your access to and use of www.tribalpunkcustoms.com (the "Site"), operated by Tribal Punk Customs ("Tribal Punk Customs", "we", "us", "our"). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.

These Terms are published in accordance with the Information Technology Act, 2000 and Rule 3(1)(a) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

2. About Us

The Site is operated by Tribal Punk Customs, a performance tuning and custom fabrication workshop with registered office at Bandra Kurla Complex (BKC), Bandra East, Mumbai, Maharashtra and main workshop at Goregaon East, Mumbai. We also operate a Master Garage at Bir, Himachal Pradesh, and work with affiliated partner garages across India.

3. Nature of This Site

This Site is an informational and enquiry platform. It allows you to:

• Learn about our services, history, and capabilities
• Submit an enquiry through the contact form
• Read editorial content (blog, testimonials)
• View images of past builds and projects

The Site does not facilitate online bookings, payments, or e-commerce transactions. No part of the Site constitutes an offer, contract, or binding commitment. All workshop services are arranged separately through direct communication and a signed work order.

4. Geographic Scope

The Site and our services are directed solely at users within India. By using the Site, you confirm that you are accessing it from within India and consent to your information being processed under Indian law.

5. Quotes & Estimates

Any pricing, lead times, scope of work, or specifications discussed in response to an enquiry — whether shared by email, telephone, WhatsApp, or in person — are preliminary estimates, not binding quotations or contracts. Final pricing, timelines, and deliverables are confirmed only through a separately executed work order or build agreement between you and Tribal Punk Customs.

Performance figures, dyno readings, lap times, build photographs, and case studies on the Site reflect specific past projects. Outcomes on your vehicle will depend on its make, model, age, condition, modifications history, intended use, terrain, and the agreed scope of work, and may differ materially from any example shown.

6. Submitting an Enquiry

When you use our contact form, you confirm that:

• The information you provide is accurate and complete to the best of your knowledge
• You are the rightful owner of the email address and phone number submitted, or have the authority to use them
• You are at least 18 years of age
• You consent to us contacting you in connection with the enquiry by telephone, SMS, email, or WhatsApp

7. Workshop Services & Build Work

This section describes general principles that apply when our discussion progresses from an enquiry into actual workshop work. Detailed commercial terms are set out in the signed work order for each project.

(a) Timelines. All timelines communicated through the Site or during early discussions are indicative. Custom fabrication, performance tuning, and caravan builds are bespoke processes that depend on parts availability (including imported components subject to customs and shipping), the condition of the donor vehicle, and unforeseen technical findings during disassembly. We will keep you informed of any material schedule changes.

(b) Customer-supplied parts. Where a customer chooses to supply their own parts (engines, ECUs, suspension components, electronics, finishes, etc.), Tribal Punk Customs does not warrant the quality, performance, durability, or compatibility of those parts. We will fit them with reasonable skill and care, but liability for the parts themselves remains with the customer or the original part manufacturer.

(c) Third-party warranties. Components supplied by manufacturers, distributors, or third-party brands are covered only by the warranty offered by that manufacturer or supplier. Tribal Punk Customs facilitates such warranty claims where reasonably practicable but is not the warrantor.

(d) Vehicle storage. Vehicles left at our workshop are stored at the customer's risk. We exercise reasonable care, but recommend that customers maintain comprehensive insurance covering the vehicle for the duration of any workshop visit.

(e) Road legality & regulatory compliance. Some performance modifications may affect the vehicle's compliance with road-use regulations, emission norms, or insurance terms in certain jurisdictions. It is the customer's responsibility to ensure that the agreed scope of work is appropriate for their intended use. We will flag any obvious concerns but cannot accept liability for downstream regulatory or insurance consequences.

8. Photography & Portfolio Rights

Tribal Punk Customs reserves the right to photograph, video-record, and document vehicles and builds undertaken at our workshop, and to use that material — including before/after imagery, dyno data, build sequences, and finished-vehicle photography — for promotional purposes including our Site, social media (Instagram and others), portfolio, blog, press, and case studies. Such use will not disclose personal identifying information (such as registration plates or customer names) without your prior consent.

If you wish to opt out of having your build featured, please notify us in writing at the time of placing the work order, or by emailing our Grievance Officer (Section 15).

9. Acceptable Use

You agree not to:

• Submit false, misleading, or fraudulent enquiries
• Use automated tools (scripts, bots, scrapers, crawlers) to interact with the Site in any manner that exceeds normal browsing
• Attempt to access, probe, scan, or test the vulnerability of the Site, its systems, or its underlying infrastructure
• Interfere with or disrupt the Site, the servers hosting it, or any networks connected to it
• Use the Site for any unlawful, fraudulent, or malicious purpose
• Submit content that is defamatory, obscene, infringing, threatening, hateful, or otherwise unlawful
• Impersonate any person or misrepresent your affiliation with any person or entity

10. Intellectual Property

All content on the Site — including text, photographs, videos, build galleries, brand marks, logos, page layouts, and design elements — is the property of Tribal Punk Customs or its licensors and is protected by Indian and international copyright, trademark, and other intellectual property laws.

You may not reproduce, republish, transmit, distribute, modify, or commercially exploit any of this content without our prior written permission. You may share direct links to our pages on social media and quote short excerpts with proper attribution to Tribal Punk Customs.

11. Third-Party Links

The Site may contain links to third-party websites, including partner garages, Instagram, Google Maps, and other external resources. We do not control and are not responsible for the content, accuracy, privacy practices, or availability of those sites. The presence of a link does not imply endorsement.

12. Disclaimer of Warranties

The Site and its content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including (without limitation) implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, or freedom from viruses or harmful components. We do not warrant that the Site will be uninterrupted, secure, or error-free.

Any warranty applicable to actual workshop services or build work is governed exclusively by the signed work order for that project, and is not extended or modified by anything on the Site.

13. Limitation of Liability

To the maximum extent permitted under Indian law, Tribal Punk Customs, its founders, employees, and affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or in connection with your use of the Site — including but not limited to loss of profits, business, data, goodwill, or vehicle downtime — even if we have been advised of the possibility of such damages.

Our total aggregate liability arising from your use of the Site shall not exceed INR 1,000. Liability arising from actual workshop services is governed by the relevant signed work order.

14. Indemnification

You agree to indemnify and hold harmless Tribal Punk Customs, its founders, employees, and affiliates from and against any claims, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any applicable law or third-party right.

15. Grievance Contact

In accordance with the Information Technology Act, 2000 and the rules made thereunder, the following individual is appointed as our Grievance Officer for matters relating to the Site:

Complaints will be acknowledged within 48 hours and resolved within 30 days.

16. Governing Law & Jurisdiction

These Terms and any dispute arising out of or in connection with them, or your use of the Site, shall be governed by and construed in accordance with the laws of India. The courts at Mumbai, Maharashtra shall have exclusive jurisdiction over any such dispute.

17. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, technology, applicable law, or business practices. When we do, the revised version will be posted on this page with an updated "Last updated" date. For material changes we will take reasonable steps to provide additional notice on the Site. Continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.

18. Severability & Entire Agreement

If any provision of these Terms is found by a court of competent jurisdiction to be unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tribal Punk Customs regarding your use of the Site.
